5.1. Issue a construction contract under a lump sum basis based on the construction documentation whereby design liability is undertaken by the Designer/Project Manager;

5.2. If construction contract negotiations are not successful, the Client may begin negotiations with an alternative contractor and the Designer/Project Manager shall facilitate as the Client’s agent[1];

5.3. Secure compliance by sub-contractors with the requirements of the contract documents (the Project Manager does not guarantee the performance of third-parties whether nominated by the Client or otherwise);

5.4. Ensure that the necessary approvals are obtained from other agencies (e.g. Buildings Department, landlord, building management office) prior to the commencement of site works.

[1] The Designer/Project Manager’s longer period of familiarity with the project and existing working relationships with the trade contractors, vendors, consultants, and specialist contractors reduces learning curves and improves programme performance; difficulties may also arise regarding apportioning design liability should an alternative contractor be appointed.
